Terms and Conditions

PRUK Beefeater Christmas Prize Draw:

1. Open to UK residents aged 18 and over, excluding employees and their immediate families of the Promoter, their agents or anyone professionally connected with the administration of this promotion. Excludes residents of the Isle of Man and Channel Islands.

  • The promotion shall commence at 00:00 on 7th December 2020 and will close at 12:00 on 18th December 2020 (the “Promotional Period”). Entries received outside of the Promotional Period will not be valid.

3. A registered Instagram account is required to enter.

4. To enter entrants must log into their social media account, comment on influencer’s Christmas #AD post with Beefeater Gin, tagging someone they can’t wait to share a gin with this Christmas. You must also use #BeefeaterGin in the comment. Entries not meeting these criteria shall not be valid.

5. Only one entry per person during the Promotional Period and only the first entry will be valid. Additional entries will not be valid.

6. Any entries received from private accounts will not be entered due to privacy restrictions. To enter from a private account, you must amend your account settings to a public account in order for entry to be accepted. The account must remain public until the end of the promotion in order to be contacted in the event that your entry is a winning entry.

7. Any entry:

a. must be suitable for display and publication online and should not be obscene or indecent (including but not limited to nudity, pornography or profanity),

b. must not contain defamatory statements or words or symbols that are offensive either generally or to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group.

c. must not include threats to any person, place, business or group,

d. must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations, network standards or the Pernod Ricard Code for Commercial Communications;

e. must not contain or refer to any products other than those of Pernod Ricard and it must not contain or reference any third party trademarks or logos (other than those of Pernod Ricard) unless such inclusion is merely incidental and is not unduly prominent and as long as it is included with due cause and in such a way that it does not take unfair advantage of any third party trademarks;

c. must not contain any copyrighted works (other than as owned by the entrant);

d. must not include any link to inappropriate drinking; and

e. must not include images of anyone who is or appears to be under the age of 25 (in order to comply with the Portman Group’s Code of Practice).

8. Any entry not complying with any of these conditions or the spirit of these conditions in the opinion of the Promoter will not be valid.

9. If anyone, other than you, appears in your entry, you must have their permission to use their name or image in the manner contemplated by this promotion.

10. If any group of people elects to collaborate on a submission, they are required to designate one person as the agent of the group to enter the promotion, agree to these terms and conditions and accept the prize on behalf of the group.

11. By participating in this promotion, you agree to release, discharge and hold the Promoter harmless from any and all injuries, liability, losses and damages of any kind resulting from your participation in this promotion (save that nothing shall limit the Promoter’s liability for fraud, or for death or personal injury caused by its negligence).

12. If you submit an entry that includes materials in which the rights are owned by a third party, including intellectual property rights such as copyright and trademarks, you will be responsible for any legal action that that party may take against you or Promoter.

13. Entrants shall indemnify and hold the Promoter and their respective affiliates, directors, agents, or other partners (“the Indemnitees”) harmless from any claims, actions, proceedings, costs (including legal fees) and expenses brought or asserted by a third party against any of the Indemnitees arising as a result of the Promoter’s use of the entrant’s submission including but not limited to any breach of third party intellectual property rights.

14. No responsibility will be accepted for any entry that is incomplete or that does not comply with these Terms and Conditions in any way.

15. There are 12 prizes to be won and a maximum of one prize can be won per person / influencer post. The prize is a Christmas Beefeater Hamper of the Promoter’s choice. Winner must be aged 18 or over and will be required to provide proof to claim the prize. The prize must be taken as stated and no compensation will be owed or payable if a winner in unable to use the prize as stated.

16. The first 12 entries drawn at random from all valid entries shall win the prize. In the event of any dispute the decision of the Promoter is final. No correspondence will be entered. Proof of age may be required.

17. The winner will be notified via a direct or public message or tag on Instagram to the account used by the winner to make the entry within 28 days of the relevant draw. The winner has 24 hours to claim the prize. If the prize goes unclaimed or the winner is unable to redeem the prize, the prize will lapse, and the Promoter reserves the right to offer the prize to an alternative winner in accordance with these terms or not to make further offers of the prize.

18. All prizes are non-transferable and non-refundable. No cash alternative is available, and no compensation is provided in the event that a winner is unable to redeem the prize. In the unlikely event of the prize or any part of it not being available the Promoter reserves the right to offer an alternative or equal or similar value.

19. No applications from agents, third parties, organised groups or entries automatically generated (including, but not limited to, those generated by computer, application, or any type of software) or otherwise outside the instructions or spirit of the promotion will be valid. No incomplete, illegible or corrupted entries or entries not in accordance with the rules will be valid.

20. If an act, omission, event or circumstance occurs which us beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

21. Responsibility is not accepted for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind.

22. The Promoter reserves the right to verify the eligibility of entrants and/or the validity of entries. The Promoter may require such information as it considers reasonably necessary for such verification and the prize may be withheld until and unless the Promoter (in its sole discretion) is satisfied with the verification.

23. Owing to exceptional circumstances outside its reasonable control and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions at any stage but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

24. By entering the Promotion, all entrants will be deemed to have accepted and be bound by the terms and conditions and consent to the transfer of their personal data to the Data Controller and relevant third parties for the purposes of the administration of this Promotion and any other purposes to which the entrant has consented. All entry instructions form part of the terms and conditions.

25. Insofar as is permitted by law, the Promoter, its agents or affiliates will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up or use of the prize except where it is caused by the direct negligence of the Promoter. Your statutory rights are not affected. Promoter shall not be liable for any indirect or consequential losses, nor any loss of profit, goodwill or opportunity.

26. Winners may be required to participate in publicity arising from this promotion. Winners agree that any intellectual property in assets created by or on behalf of the Promoter in respect of such publicity shall vest in the Promoter and the winners waive any moral or any other rights in such assets and/or shall transfer rights to the Promoter, as the Promoter determines in its sole discretion.

28. These terms and conditions and any issues or disputes which may arise out of or in connection with these terms and conditions (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
